These Terms of Service apply to inquiries, quotations, vehicle sourcing and related services provided through PrimeDrive Motors.
PrimeDrive Motors is operated by Qingdao Tuohai Cross-Border E-Commerce Operations Co., Ltd., based in Qingdao, China.
By submitting an inquiry, requesting a quotation, placing an order or otherwise conducting a transaction with us, you acknowledge and agree to the applicable terms below.
1. VEHICLE INFORMATION
PrimeDrive Motors supplies and sources used and new vehicles from China for international buyers.
Vehicle information may include model year, mileage, specifications, photographs, videos, inspection information and other available details.
For used vehicles, normal wear, cosmetic imperfections, repairs, replaced parts or other conditions may exist depending on the vehicle's age, mileage and history.
We aim to provide vehicle information accurately based on the information reasonably available to us. Buyers should review all available vehicle information before confirming a purchase.
Where requested and reasonably available, additional photographs, videos or inspection information may be provided before the order is confirmed.
2. VEHICLE AVAILABILITY
Vehicle availability is subject to change.
A vehicle displayed on our website does not guarantee that the vehicle remains available at the time an inquiry is submitted.
Availability will be confirmed before an order or payment arrangement is finalized.
3. QUOTATIONS AND PRICES
Prices displayed on the website or provided in quotations may be based on EXW, FOB, CIF or another agreed trade term.
The applicable price term will be identified in the quotation or transaction documents.
Shipping costs, port charges, insurance, inspection costs, export-related costs and other charges may vary depending on the vehicle, destination, shipping method and market conditions.
Unless otherwise stated in writing, website prices and preliminary quotations should not be considered a final binding offer.
A final quotation or transaction document will specify the applicable vehicle, price, trade term and other agreed conditions.
4. EXW, FOB AND CIF
EXW, FOB and CIF quotations have different scopes of cost and responsibility.
The exact responsibilities of the buyer and seller will be confirmed in the applicable quotation, proforma invoice, sales contract or other transaction document.
Where an Incoterms rule is expressly stated in transaction documents, the stated Incoterms rule and edition will apply as specified in those documents.
5. ORDERS AND VEHICLE CONFIRMATION
Before making payment, buyers should confirm the vehicle, specifications, available condition information, price, trade term and other important transaction details.
An inquiry submitted through the website, WhatsApp or email does not by itself constitute a confirmed order.
An order becomes confirmed according to the payment and transaction conditions stated in the applicable quotation, proforma invoice, sales contract or other written agreement.
6. PAYMENT
Payment instructions, deposit requirements, payment deadlines and balances will be confirmed for each transaction.
Buyers must make payments only to payment details officially provided and confirmed by PrimeDrive Motors or Qingdao Tuohai Cross-Border E-Commerce Operations Co., Ltd.
Buyers should verify payment instructions with us before transferring funds, particularly if they receive any unexpected request to change bank or payment details.
Bank charges, intermediary bank charges and other payment-related fees may apply depending on the payment method and transaction.
7. VEHICLE INSPECTION
Buyers may request available photographs, videos and vehicle condition information before purchase.
Where feasible, buyers may also arrange an independent inspection or appoint a representative or inspection agent in China before shipment.
Inspection arrangements, scope and any related costs should be agreed before the inspection takes place.
Once a buyer has reviewed and accepted the available vehicle information or inspection results and confirmed the transaction, that confirmation may be used as part of the agreed vehicle condition record.
8. EXPORT DOCUMENTATION
PrimeDrive Motors may assist with vehicle export procedures and documentation from China according to the agreed transaction.
Export procedures, documentation requirements and processing times may vary according to the vehicle and applicable regulations.
Estimated processing times are not guarantees where delays arise from government authorities, customs, ports, shipping companies or other circumstances outside our reasonable control.
9. INTERNATIONAL SHIPPING
International shipping may be arranged according to the agreed trade term and destination.
Shipping schedules, vessel availability, transit times and estimated arrival dates are subject to change.
Any shipping or arrival date provided before shipment is an estimate unless expressly agreed otherwise in writing.
Delays caused by carriers, ports, customs, weather, congestion, government action or other circumstances outside our reasonable control may occur.
10. IMPORT REGULATIONS AND CUSTOMS
Import regulations differ by country and may change.
The buyer is responsible for confirming that the vehicle can legally be imported, registered and used in the destination country before confirming the purchase.
Unless expressly included in our written quotation or agreement, the buyer is responsible for destination-country customs clearance, import duties, taxes, registration fees, licensing requirements, local inspections and other destination charges or requirements.
PrimeDrive Motors does not guarantee that a particular vehicle will qualify for importation or registration in every country.
11. CANCELLATIONS, RETURNS AND REFUNDS
Vehicles are individually sourced, reserved, prepared and/or processed for export according to each transaction.
Cancellation, return and refund eligibility therefore depends on the stage of the transaction and the specific written agreement.
Deposits, sourcing expenses, inspection expenses, documentation expenses, modification expenses, transportation expenses, export processing expenses or other costs already incurred may be non-refundable where stated in the applicable quotation, invoice, contract or written agreement.
The specific cancellation and refund terms applicable to an order will be governed by the relevant transaction documents and our published refund policy.
12. VEHICLE MODIFICATIONS AND SPECIAL REQUESTS
Any modification, accessory installation, repair or other special work requested by the buyer must be confirmed separately.
Additional costs and processing time may apply.
Work that has already been authorized and performed may not be refundable or reversible.
13. THIRD-PARTY SERVICES
Some parts of a transaction may involve third parties, including inspection companies, inland transport providers, shipping companies, ports, banks, customs brokers or other service providers.
PrimeDrive Motors is responsible for the services we expressly agree to provide, but cannot guarantee the independent performance or schedules of third parties beyond our reasonable control.
14. WEBSITE INFORMATION
We make reasonable efforts to keep information on our website accurate and current.
However, vehicle availability, prices, specifications, shipping costs and other information may change without prior notice.
Images and information on the website are intended to help buyers evaluate vehicles and services. Final transaction details should be confirmed in the applicable quotation, invoice, contract or other written agreement.
15. LIMITATION OF RESPONSIBILITY
To the extent permitted by applicable law, PrimeDrive Motors and Qingdao Tuohai Cross-Border E-Commerce Operations Co., Ltd. are not responsible for losses caused by circumstances outside our reasonable control, including carrier delays, port congestion, customs delays, changes in destination-country import regulations, government actions or force majeure events.
Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited.
16. TRANSACTION DOCUMENTS
If the terms of a specific quotation, proforma invoice, sales contract or other written transaction agreement differ from these general website Terms of Service, the specific transaction document will govern that transaction to the extent of the inconsistency.
17. CHANGES TO THESE TERMS
We may update these Terms of Service when our services, business practices or applicable requirements change.
The version published on our website will show the latest applicable general terms.
